| Výzva zahraničným veriteľom podľa Nariadenia (EÚ) 2015/848 V súlade s Nariadením Európskeho parlamentu a Rady (EÚ) č. 2015/848 zo dňa 20.05.2015 ako správca dlžníka: Tibor Kurina, nar. 25.09.1983, trvalý pobyt Komárno (ďalej ako „dlžník“), oznamujem, že na majetok dlžníka bolo uznesením Okresného súdu Nitra, sp. zn. 31OdK/120/2025 – 19 zo dňa 25.11.2025, zverejneným v insolvenčnom registri dňa 25.11.2025, vyhlásený konkurz a za správcu dlžníka bol ustanovený JUDr. Patrik Pupík, so sídlom kancelárie Šípová 3, 949 01 Nitra, značka správcu S2094.  Táto výzva sa vzťahuje na zahraničných veriteľov, ktorí majú obvyklý pobyt, bydlisko alebo registrované sídlo v iných členských štátoch Európskej únie ako v Slovenskej republike. Vyhlásením konkurzu sa začína konkurz. Konkurz je vyhlásený zverejnením uznesenia o vyhlásení konkurzu v insolvenčnom registri (§ 167a ods. 3 zákona č. 7/2005 Z. z. – ďalej len „ZKR“).  Veriteľ (§ 166a a § 166c ZKR) má právo prihlásiť sa do konkurzu do času, kým správca nezverejní oznámenie, že ide zostaviť rozvrh. Ustanovenia § 29 ods. 1, 2, 4 až 6, 8 až 10, § 30 a § 31 ZKR sa použijú primerane.  Prihlásiť sa môže aj veriteľ, ktorý má pohľadávku voči inej osobe ako dlžníkovi, ak je zabezpečená zabezpečovacím právom vzťahujúcim sa k majetku dlžníka. Takýto veriteľ môže byť v konkurze uspokojený iba z výťažku získaného speňažením majetku, ktorý zabezpečuje jeho pohľadávku, pričom hlasovacie práva na schôdzi veriteľov môže vykonávať iba v rozsahu, v akom jeho pohľadávka bude pravdepodobne uspokojená z majetku, ktorým je zabezpečená (§ 167l ods. 2 ZKR). Prihláška sa podáva v základnej prihlasovacej lehote do 45 dní od vyhlásenia konkurzu spôsobom podľa § 28 ods. 2 ZKR. Ak veriteľ doručí správcovi prihlášku neskôr, na prihlášku sa prihliada, veriteľ však nemôže vykonávať hlasovacie právo. Doručenie prihlášky správcovi má pre plynutie premlčacej lehoty a zánik práva rovnaké právne účinky ako uplatnenie práva na súde (§ 167l ods. 3 ZKR).  Prihláška sa podáva: • elektronicky prostredníctvom na to určeného elektronického formulára špecializovaného portálu do elektronickej schránky správcu; prihláška musí byť autorizovaná, inak sa na ňu neprihliada, • ak ide o zahraničného veriteľa podľa osobitného predpisu, prihláška sa podáva u správcu; na doručovanie sa primerane použije Civilný sporový poriadok (§ 28 ods. 2 ZKR).  Prihláška musí obsahovať základné náležitosti podľa § 29 ZKR, najmä: • identifikáciu veriteľa, • identifikáciu dlžníka, • právny dôvod vzniku pohľadávky, • poradie uspokojovania pohľadávky zo všeobecnej podstaty, • celkovú sumu pohľadávky, rozdelenú na istinu a príslušenstvo.  Pohľadávka sa uplatňuje v eurách; ak sa neuplatní v eurách, sumu pohľadávky určí správca prepočtom podľa referenčného výmenného kurzu určeného a vyhláseného v deň vyhlásenia konkurzu Európskou centrálnou bankou alebo Národnou bankou Slovenska; pri mene bez referenčného kurzu určí sumu správca s odbornou starostlivosťou. K prihláške sa prikladajú listiny preukazujúce v nej uvedené skutočnosti; účtovná jednotka uvedie aj vyhlásenie, či a v akom rozsahu o pohľadávke účtuje (§ 29 ods. 5 a 6 ZKR). Veriteľ, ktorý nemá na území Slovenskej republiky svoj obvyklý pobyt, bydlisko alebo sídlo, je povinný ustanoviť si zástupcu na doručovanie s bydliskom alebo sídlom na území Slovenskej republiky a ustanovenie zástupcu oznámiť správcovi; inak sa mu budú písomnosti doručovať zverejnením v insolvenčnom registri (§ 29 ods. 8 ZKR). In accordance with Regulation (EU) 2015/848 of the European Parliament and of the Council of 20 May 2015 on insolvency proceedings, I, JUDr. Patrik Pupík, insolvency trustee (the “Trustee”), hereby inform you as follows: On the assets of the debtor Tibor Kurina, born on 25 September 1983, permanent residence: Komárno, Slovak Republic (the “Debtor”), bankruptcy (insolvency) proceedings have been opened by the District Court Nitra by its decision (order) ref. no. 31OdK/120/2025 – 19 of 25 November 2025, by which the Court: (i) declared bankruptcy over the Debtor’s assets and (ii) appointed JUDr. Patrik Pupík, Šípová 3, 949 01 Nitra, Slovakia, licence no. S2094 as the Trustee. This decision was published in the Slovak Insolvency Register on 25 November 2025.  This notice is addressed to foreign creditors, i.e. creditors who have their habitual residence, domicile or registered office in a Member State of the European Union other than the Slovak Republic, including tax authorities and social security institutions of Member States.  By the declaration of bankruptcy, the bankruptcy proceedings are opened. Under Section 167a(3) of Act No. 7/2005 Coll. on Bankruptcy and Restructuring, as amended (the “Bankruptcy Act”), bankruptcy is deemed to be declared upon publication of the decision on declaration of bankruptcy in the Insolvency Register.  1. Right to lodge claims and time limits Creditors whose claims fall under Sections 166a and 166c of the Bankruptcy Act (claims to be satisfied in bankruptcy or unaffected claims) have the right to lodge their claims in these bankruptcy proceedings until the Trustee publishes a notice that a final distribution schedule (payment schedule) is going to be drawn up. Sections 29(1), (2), (4) to (6), (8) to (10), 30 and 31 of the Bankruptcy Act apply mutatis mutandis.  The basic time limit for lodging claims is 45 days from the declaration of bankruptcy, i.e. within 45 days from 25 November 2025 (until 9 January 2026, inclusive). If a creditor lodges its claim after expiry of this basic 45‑day period, the claim will still be taken into account in the bankruptcy; however, the creditor will not be entitled to exercise voting rights in creditors’ meetings. The lodging of a claim with the Trustee has the same effects on limitation and extinction periods as if an action were brought before a court.  A creditor who has a claim against another person than the Debtor may also lodge that claim in these proceedings, provided that the claim is secured by a security right over assets belonging to the Debtor. Such a creditor may be satisfied in the bankruptcy only from the proceeds of the realisation of the asset securing its claim and may exercise voting rights at creditors’ meetings only to the extent to which its claim is likely to be satisfied from the secured assets.  2. Manner of lodging claims As a rule, claims are lodged in the form of a proof of claim (application for registration of a claim) in accordance with Section 28(2) of the Bankruptcy Act. In general, claims are filed electronically via a designated electronic form to the Trustee’s electronic mailbox and must be duly authorised (electronically signed); otherwise they are disregarded. If the creditor is a foreign creditor within the meaning of Regulation (EU) 2015/848, the claim is lodged directly with the Trustee, and service of documents is governed by the Slovak Civil Dispute Procedure Code. For smooth processing it is strongly recommended that claims be drawn up in Slovak or be accompanied by a translation into Slovak. 3. Minimum content of the proof of claim A proof of claim must contain at least the following particulars required by Section 29 of the Bankruptcy Act, otherwise it may be disregarded:  1. Identification of the creditor • for a natural person: name, surname and address of residence; • for a self‑employed natural person: business name, name and surname (if different), identification number or other identifier and place of business; • for a legal entity: company name, identification number or other identifier and registered office. 2. Identification of the Debtor (bankrupt), i.e. name, surname and permanent residence (for a natural person). 3. Legal basis of the claim, including a brief description of the underlying contract, judgment or other legal ground. 4. Ranking of the claim for the purposes of its satisfaction from the general estate (for example, ordinary unsecured, subordinated, etc.). 5. Total amount of the claim, broken down into principal and accessories (interest, fees, costs), with accessories further broken down by their legal basis. For each secured claim, a separate proof of claim must be filed, indicating the secured amount, the type and ranking of the security right, the collateral (subject of security) and the legal basis for the creation of the security right.  The claim must be stated in euro (EUR). If the claim is not stated in euro, the Trustee will convert it into euro using the reference exchange rate in force on the date of declaration of bankruptcy as published by the European Central Bank or the National Bank of Slovakia; if no reference rate exists, the Trustee will determine the amount with professional care.  The proof of claim must be accompanied by documents evidencing the facts stated in the claim (e.g. contracts, invoices, court decisions, account statements). A creditor who is an accounting entity should also state whether and to what extent the claim is recorded in its accounts, or why it is not recorded.  4. Agent for service in the Slovak Republic A creditor who does not have its habitual residence, domicile or registered office in the Slovak Republic is obliged to appoint an agent for service of documents with an address in the Slovak Republic and notify the Trustee of such appointment. If the creditor fails to do so, documents will be served on that creditor by publication in the Insolvency Register only.  5. Final remark This notice is provided in English for the convenience of foreign creditors. In the event of any discrepancy between this notice and the applicable provisions of Slovak law or the decision of the District Court Nitra ref. no. 31OdK/120/2025 – 19 of 25 November 2025, Slovak law and the Slovak court decision shall prevail.
