V súlade s Nariadením Európskeho parlamentu a Rady (EÚ) č. 2015/848 zo dňa 20. mája 2015 o insolvenčnom konaní́, ako správca vyššieoznačeného úpadcu, oznamujem, že Uznesením Okresného súdu v Banskej Bystrici zo dňa 02.11.2022, č. k. 6OdK/401/2022, bol vyhlásený konkurz na majetok úpadcu.

In accordance with the Regulation (EU) 2015/848 of the European parliament and of the Council of 20th May 2015 on insolvency proceedings, as the bankruptcy trustee of the above-mentioned debtor I announce, that bankruptcy has been declared for the Debtor's property by Order of the District Court Banská Bystrica, proc. No: 6OdK/401/2022, dated on November 2th 2022.

Toto uznesenie Okresného súdu v Banskej Bystrici bolo zverejnené v Obchodnom vestníku č. 216/2022, dňa 10.11.2022. Dňom 11.11.2022 bol vyhlásený konkurz na majetok úpadcu.

The Order of the District Court Banská Bystrica was published in a Commercial Journal No. 216/2022, on November 10^th 2022. The bankruptcy for the Debtor's property has been declared on November 11^th 2022.

V zmysle Zákona č. 7/2005 Z. z. o konkurze a reštrukturalizácii a o zmene a doplnení niektorých zákonov (ďalej len „ZKR"), veritelia úpadcu môžu v lehote 45 dní od vyhlásenia konkurzu prihlásiť svoje pohľadávky v jednom rovnopise správcovi na adresu: Mgr. Robert Antal, Ul. Kláry Jarunkovej 2, 974 04 Banská Bystrica, Slovenská republika. Ak veriteľ doručí správcovi prihlášku neskôr, na prihlášku sa prihliada, veriteľ však nemôže vykonávať hlasovacie právo a ďalšie práva spojené s prihlásenou pohľadávkou. Zabezpečený veriteľ úveru na bývanie je oprávnený sa prihlásiť, iba ak je už pohľadávka z úveru na bývanie v celom rozsahu splatná, alebo ak sa prihlásil zabezpečený veriteľ, ktorého zabezpečovacie právo je skoršie v poradí. Prihláškou možno uplatniť aj budúcu pohľadávku alebo pohľadávku, ktorej vznik je viazaný na splnenie podmienky alebo pohľadávku, ktorú má veriteľ voči inej osobe ako úpadcovi, ak je zabezpečená zabezpečovacím právom vzťahujúcim sa k majetku úpadcu. Prihláška musí byť podaná na predpísanom tlačive a musí obsahovať základné náležitosti, inak sa na prihlášku neprihliada.

Pursuant to Act No. 7/2005 Coll. on Bankruptcy and Restructuring and on Amendments and Supplements to Certain Acts (hereinafter referred to as "BRA"), the bankrupt's creditors may within 45 days from the declaration of bankruptcy, lodge their claims in one copy to the trustee at the address: Mgr. Robert Antal, seated Kláry Jarunkovej street 2, 974 04 Banská Bystrica, Slovak Republic. If the creditor delivers the application to the trustee after the deadline, the application is taken into account, but the creditor can not exercise voting rights and other rights associated with the lodged claim. The secured creditor of the housing loan is entitled to lodge the claim, only if the claim from the loan for housing is allready payable in its entirety, or if a secured creditor, whose security right is earlier in the order, has lodged the claim. The application may also apply for creditor´s claim arising in the future or depending on the fulfillment of certain conditions or creditor´s claim applying against another person as a debtor, if it is secured by a security right relating to the property of the bankrupt. The application must be completed in the relevant registration form and must contain the requirements established by law, otherwise the application will not be considered.

Základnými náležitosťami prihlášky sú meno, priezvisko a bydlisko alebo názov a sídlo veriteľa a úpadcu, právny dôvod vzniku pohľadávky, poradie uspokojovania pohľadávky, celková suma pohľadávky a podpis. V prihláške podmienenej pohľadávky musí byť uvedená aj skutočnosť, na základe ktorej má pohľadávka vzniknúť alebo podmienka, od ktorej závisí vznik pohľadávky.

The basic requirements of the application are as follows - the information about the name, surname and the seat of the creditor and of the debtor, the legal cause of the claim, ranking of the satisfaction of the claim from the bankrupt’s general estate, total amount of claim and signature of the registration. The application for a contingent claim must also state the fact on the basis of which the claim is to arise or the condition on which the arising of the claim depends.

Na prihlášky, ktoré nebudú spĺňať zákonom stanovené podmienky, nebudú podpísané a datované sa v konkurze neprihliada. Správca ani súd nie sú povinní vyzvať veriteľa na doplnenie alebo opravu neúplnej alebo nesprávnej prihlášky.

If the claims application does not meet the conditions established by law or is not signed or dated, these claims will not be considered as claims claimed in bankruptcy proceedings. Neither the trustee nor the court is obliged to ask the creditor to complete or correct an incomplete or incorrect application.

Celková suma pohľadávky sa v prihláške rozdelí na istinu a príslušenstvo, pričom príslušenstvo sa v prihláške rozdelí podľa právneho dôvodu vzniku. Pohľadávka sa uplatňuje v eurách. Ak sa pohľadávka neuplatní v eurách, sumu pohľadávky určí správca prepočtom podľa referenčného výmenného kurzu určeného a vyhláseného v deň vyhlásenia konkurzu Európskou centrálnou bankou alebo Národnou bankou Slovenska. Ak je pohľadávka uplatnená v mene, ktorej referenčný výmenný kurz Európska centrálna banka ani Národná banka Slovenska neurčuje a nevyhlasuje, sumu pohľadávky určí správca s odbornou starostlivosťou.

The total amount of the claim is divided into principal and accessories in the application, while the receivables accessories are divided in the application in accordance with the legal cause. The claim must be made in EURO. If the claim is not logged in euros, the amount of the claim is determined by the bankruptcy trustee´s calculation according to the reference exchange rate set and published on the day of the bankruptcy declaration by the European Central Bank or National Bank of Slovakia. If the claim is lodged in currency that the European Central Bank or National Bank of Slovakia reference rate does not indicate or announce, the amount of the claim will be determined by the bankruptcy trustee with professional care.

K prihláške sa pripoja listiny preukazujúce v nej uvedené skutočnosti. Veriteľ, ktorý je účtovnou jednotkou, v prihláške uvedie vyhlásenie, či o pohľadávke účtuje v účtovníctve, v akom rozsahu, prípadne dôvody, prečo o pohľadávke v účtovníctve neúčtuje.

Documents proving the information provided during the registration of claim must be attached to the registration of claim. The creditor, which is an accounting unit, shall state in the application whether it accounts for the receivable in accounting, to what extent, or the reasons why it does not account for the receivable in accounting.

Veriteľ, ktorý nemá na území Slovenskej republiky bydlisko alebo sídlo alebo organizačnú zložku podniku, je povinný ustanoviť si zástupcu na doručovanie s bydliskom alebo sídlom na území Slovenskej republiky a ustanovenie zástupcu písomne oznámiť správcovi, inak sa mu budú písomnosti doručovať len zverejnením v Obchodnom vestníku.

A creditor who does not have a residence or headquarters or an organizational branch of a company in the territory of the Slovak Republic is obliged to appoint a representative for delivery with a residence or headquarters in the territory of the Slovak Republic and to notify the trustee in writing of the appointment of a representative, otherwise delivery to such a creditor will be made only by publication in the Commercial Journal.

Podanie, ktorým bola uplatnená pohľadávka, ktorá sa v konkurze uplatňuje prihláškou, nemožno opraviť ani doplniť.

The claim application claimed in the bankruptcy can not be corrected or changed.

Toto zverejnenie sa vzťahuje k zahraničným veriteľom, ktorých pobyt a sídlo nie je známe z dokumentov dlžníka.

This disclosure is dedicated to foreign creditors, whose place of residence or seat is not obvious from the Debtor business documentation.
