V súlade s Nariadením Rady (ES) č. 1346/2000 zo dňa 29.05.2000 ako správca úpadcu Monika Daňová, nar. 14.04.1968, bytom 086 33 Zborov, Námestie československej armýdy 660/26 , oznamujem, že na majetok
úpadcu bol Uznesením Okresného súdu Prešov, spisová značka : 5OdK/97/2022 zo dňa 28.03.2022  v
Obchodnom vestníku č. 65/2022 dňa 04.04.2022 vyhlásený konkurz a za správcu bol ustanovený JUDr. Vladimír
Babin.

si to inform you, that District Court in Prešov, No. 5OdK/97/2022 on the 28.03.2022 and promulgated in the
Commercial bulletin No. 65/2022 from 04.04.2022 proclaimed bankruptcy of the bankrupt and simultaneously
appointed JUDr. Vladimír Babin as the legal guardian of the bankrupt.
Konkurz sa považuje za vyhlásený zverejnením uznesenia o vyhlásení konkurzu v Obchodnom vestníku, pričom
za deň zverejnenia (doručenia) súdneho rozhodnutia sa považuje nasledujúci deň po zverejnení súdneho
rozhodnutia v Obchodnom vestníku. Vyhlásením konkurzu sa dlžník stáva úpadcom (§ 23 ods. 1 ZKR v spojení s
ust. § 199 ods. 9 ZKR).
The bankruptcy is considered as declared by publishing the resolution on declaring the bankruptcy in the
Commercial report, whereby as the day of publishing (delivery) of the judical decision the day following the day
after the publishing of the judical decision in the Commercial report shall be considered. The deptor becomes the
bankrupt after declaring the bankruptcy (§ 23 sec. 1 BRA in connection woth the provision § 199 sec. 9 BRA).
Pohľadávka, ktorá nie je pohľadávkou proti podstate, sa v konkurze uplatňuje prihláškou (§ 28 ods.1 ZKR). The
claim, which is not the claim against the property shall be alleged by an application (§ 28 sec. 1 BRA).
Prihláška sa podáva v jednom rovnopise u správcu, pričom správcovi musí byť doručená v základnej
prihlasovacej lehote do 45 dní od vyhlásenia konkurzu; v jednom rovnopise veriteľ doručí prihlášku aj na súd (§
28 ods. 2 ZKR).

the basic registration period within 45 days from declaring the bankruptcy; in one counterpart delivers the creditor
the application to the court (§ 28 sec. 2 BRA).
Ak veriteľ doručí správcovi prihlášku neskôr, na prihlášku sa prihliada, veriteľ však nemôže vykonávať hlasovacie
právo a ďalšie práva spojené s prihlásenou pohľadávkou. Právo na pomerné uspokojenie veriteľa tým nie je
dotknuté; môže byť však uspokojený len z výťažku zaradeného do rozvrhu zo všeobecnej podstaty, ktorého
zámer zostaviť bol oznámený v Obchodnom vestníku po doručení prihlášky správcovi. Zapísanie takejto
pohľadávky do zoznamu pohľadávok správca zverejní v Obchodnom vestníku s uvedením veriteľa a prihlásenej
sumy (§ 28 ods. 3 ZKR).
If the creditor delivers the application later to the trustee, the application shall be taken into consideration, but the
creditor cannot exercise the right to vote and other related to the registered claim. The right to proportional
satisfaction of the creditor shall not be touched; he can besatisfied only from the gains put into the schedule from
the general property, whose aim to put together was published in the Commercial report after the delivery of the
application to the trustee. The registration of such claim into the list of the claims published the trustee in the
Commercial report with stating the creditor and the registered sum (§ 28 sec. 3 BRA).
Ak ide o zabezpečenú pohľadávku, v prihláške doručenej správcovi sa musí riadne a včas uplatniť aj
zabezpečovacie právo, a to v základnej prihlasovacej lehote 45 dní od vyhlásenia konkurzu, inak zanikne (§ 28
ods. 4 ZKR).
If it is an assured claim, also the security right must be duly and on time alleged in the application delivered to the
trustee in the basic registration period within 45 days from declaring the bankruptcy, otherwise it will lapse (§ 28
sec. 4 BRA).
Ak si takýto veriteľ svoju zabezpečenú pohľadávku v základnej prihlasovacej lehote neprihlási, na jeho
zabezpečovacie právo sa v konkurze neprihliada, má však proti dotknutej podstate právo na vydanie toho, o čo sa
dotknutá podstata v dôsledku toho obohatila, pričom takéto právo môže uplatniť proti dotknutej podstate ako
pohľadávku proti podstate, ktorá sa však uspokojí až po uspokojení všetkých ostatných pohľadávok proti tejto
podstate (§ 28 ods. 8 ZKR).
If such creditor does not register his assured claim in the basic registration period, his security right will not be
taken into consideration in the bankruptcy, but he has the right against the affected property to handing over that,
what the affected property in this consequencce was enriched, whereby such right can be alleged against affected
property as claim against property, which will be satisfied after satisfying all other claims against this property (§
28 sec. 8 BRA).
Prihláška musí byť podaná na predpísanom tlačive a musí obsahovať základné náležitosti, inak sa na prihlášku
neprihliada. Základnými náležitosťami prihlášky sú: a) meno, priezvisko a bydlisko alebo názov a sídlo veriteľa, b)
meno, priezvisko a bydlisko alebo názov a sídlo úpadcu, c) právny dôvod vzniku pohľadávky, d) poradie
uspokojovania pohľadávky zo všeobecnej podstaty, e) celková suma pohľadávky, f) podpis (§ 29 ods. 1 ZKR).
