V súlade s Nariadením Rady (ES) č. 1346/2000 zo dňa  29.5.2000, ako správca úpadcu Vlasta Billová , trvale bytom na ul. Dukelská 1365/31, 900 01 Modra dátum narodenia 01.04.1960 (ďalej len „úpadca“) Vám oznamujem, že uznesením Okresného súdu Bratislava I. č. k. 33OdK/69/2020  zo dňa 08.09.2020 bol vyhlásený konkurz na majetok úpadcu.

According to the Direction of the European Council No. 1346/2000 dated 29th May 2000, as the bankruptcy trustees of the bankrupt Vlasta Billová, resident at Dukelská 1365/31, 900 01 Modra, born 01.04.1960, (hereinafter only „the Bankrupt“) our duty is to inform you that with the resolution of the District Court in Bratislava I. No. 33OdK/69/2020 dated 08.09.2020 bankruptcy was declared on the Bankrupt´s estate.

Toto uznesenie Okresného súdu Bratislava I.  nadobudlo právoplatnosť dňa 30. 09. 2020. Týmto dňom bol vyhlásený konkurz na majetok úpadcu.

This resolution of the District Court in Bratislava I. became valid on 4th of February 2021. The bankruptcy  was declared as of this date.

V zmysle zákona č. 7/2005 Z.z. o konkurze a reštrukturalizácii (ďalej len „ZKR“) veritelia úpadcu sú povinný v lehote 45 dní od vyhlásenia konkurzu prihlásiť svoje pohľadávky  v jednom rovnopise správcovi na adresu Záhradnícka 30, Bratislava 821 08, Slovenská republika. V jednom rovnopise veriteľ doručí prihlášku aj na Okresný súd Bratislava I. Pre každú pohľadávku musí byť predložená samostatná prihláška. V prihláške sa vždy uvedie meno, priezvisko a bydlisko alebo názov a sídlo veriteľa a úpadcu, právny dôvod vzniku pohľadávky, poradie uspokojenia pohľadávky zo všeobecnej podstaty a suma pohľadávky s rozdelením na istinu a príslušenstvo, a príslušenstvo s rozdelením podľa právneho dôvodu vzniku; prihláška sa podáva na predpísanom tlačive, ktoré musí byť datované a podpísané veriteľom. Vzor tlačiva prihlášky je k dispozícii na internetovej stránke www.justice.gov.sk. Rovnakým spôsobom uplatňujú svoje pohľadávky aj veritelia pohľadávok, ktorých vznik je viazaný na splnenie podmienky, pričom sa uvedenie podmienka, od ktorej závisí vznik pohľadávky, a aj veritelia pohľadávok zabezpečených vecným právom, ktorí v prihláške uvedú druh, poradie a právny dôvod vzniku vecného práva spolu s určením majetku, ktorým je zabezpečená a sumu, do ktorej je zabezpečená.  Pohľadávka sa uplatňuje v slovenskej mene. K prihláške sa pripájajú listiny preukazujúce údaje uvedené v prihláške. Ak veriteľ nemá na území Slovenskej republiky bydlisko alebo sídlo alebo organizačnú zložku podniku, v prihláške je povinný uviesť zástupcu na doručovanie písomností, ktorý má bydlisko alebo sídlo na území Slovenskej republiky.  Ak veriteľ podáva viacero prihlášok, k prihláškam pripojí aj súhrnný prehľad údajov uvedených v jednotlivých prihláškach. Ak sa prihlasuje nepeňažná pohľadávka, k prihláške sa pripojí aj znalecký posudok určujúci hodnotu nepeňažnej pohľadávky.

According to the Act No. 7/2005 Coll. Bankruptcy and Restructuralization Act (hereinafter only „the BRA“) the creditors of the Bankrupt have to register their claims in a time period of 45 days beginning with the declaration of the bankruptcy in one copy to the trustee to the address Záhradnícka 30, Bratislava 821 08, Slovak Republic. Creditors shall lodge their claims in one original also to the Okresný súd Bratislava I. (District Court Bratislava I.) Each claim must be registered separately. The registration has to provide information about the name, surname and the address of the firm and the seat of the creditor and of the Bankrupt, the legal cause of the claim, ranking of the satisfaction of the claim from the bankrupt´s general estate and the amount of the principal and the interests, the legal cause of the interests; the registration has to be filled in a special registration form, which has to be dated and signed. The registration form can be found on the website www.justice.gov.sk. Creditors whose claims depend on the fulfillment of certain conditions register their claims in the same way. They also state in the registration form the condition on which the claim is dependent. Creditors with claims secured with securities also fill in the registration form which has to provide information about the object to which the security is tied. The claim has to be registered in Slovak currency. Documents prooving the information provided in the registration form have to be enclosed to the registration form. In case the creditor does not have a seat or an address or a branch office in the Slovak Republic a representative with an address or a seat in the Slovak Republic has to be stated. If the creditor registers more than one claim, a summarization of the registrations has to be added to the registration form. In case a non-financial claim is registered, an expert opinion stating the value of the claim has to be added.

Na prihlášky, ktoré nebudú spĺňať zákonom stanovené podmienky, nebudú podané na predpísanom tlačive, nebudú podpísané a datované, nebude k nim predložený súhrnný prehľad (viac pohľadávok) alebo znalecký posudok (nepeňažné pohľadávky) alebo nebudú doručené v stanovenej lehote sa v konkurze neprihliada. Neprihlásené vecné právo uplynutím lehoty na prihlasovanie pohľadávok zanikne. 

Registrations that will not fulfill the requirements stated by the law or will not registered on the required registration form or will not be signed or dated or a summary will not be added (more claims) or an expert opinion (non-financial claim) or will not be delivered in time will not be considered as claims in the bankruptcy. Not registered security rights lapse after the registration period elapses.

Veriteľ zodpovedá za správnosť údajov uvedených v prihláške podľa § 30 ZKR.

The creditor is responsible for the legitimacy of his registration according to the article 30 of the BRA.
