V súlade s nariadením Rady (ES) č. 1346/2000 o konkurznom konaní zo dňa 29.05.2000, Vám týmto oznamujem, že uznesením Okresného súdu Banská Bystrica pod sp. zn. 4OdK/627/2018, zo dňa 10.07.2018 (ďalej aj ako „Uznesenie“) bol vyhlásený konkurz na majetok úpadcu PaedDr. Miloš Gregora, nar. 20. 06. 1945, trvale bytom Okružná 2406/33, 960 01 Zvolen (ďalej aj ako „Úpadca“). Konkurz sa považuje za vyhlásený dňom 17.07.2018.

JUDr. Peter Škrabák, správca, so sídlom kancelárie Skuteckého 30, 974 01 Banská Bystrica, Slovenská republika, značka správcu S 1823 (ďalej aj ako „Správca“), bol Uznesením ustanovený do funkcie správcu Úpadcu.

Uznesenie bolo zverejnené v Obchodnom vestníku Slovenskej republiky pod číslom OV 135/2018 dňa 16.07.2018.

According to the Direction of the European Council No. 1346/2000 on insolvency proceedings dated 29th of May 2000, we are obliged to inform you that with the resolution of the District Court Banská Bystrica, proc. No. 4OdK/627/2018 (hereinafter referred to as the „Resolution“) bankruptcy procedure was declared on the assets of following bankrupt: PaedDr. Miloš Gregora, born in 20. 06. 1945, domicile Okružná 2406/33, 960 01 Zvolen, Slovakia (hereinafter referred to as the „Bankrupt“ or „Debtor“). The bankruptcy procedure is considered as declared on 17.07.2018.

JUDr. Peter Škrabák, Office seat at: Skuteckého 30, 974 01 Banská Bystrica, Slovak republic, identification number of the trustee S 1823 (hereinafter referred to as the „Bankruptcy administrator“ or „Trustee“), was appointed to the function of Bankruptcy administrator.

Resolution was published  in Commercial Journal of Slovak republic No.: OV 135/2018 dated on 16.07.2018.

V zmysle zákona č. 7/2005 Z. z. o konkurze a reštrukturalizácii a o zmene a doplnení niektorých zákonov v znení neskorších predpisov (ďalej aj ako „ZKR“) veritelia Úpadcu sú povinní v základnej prihlasovacej lehote 45 dní od vyhlásenia konkurzu prihlásiť svoje pohľadávky v jednom rovnopise u Správcu, na adrese: JUDr. Peter Škrabák, správca, so sídlom kancelárie Skuteckého 30, 974 01 Banská Bystrica, Slovenská republika.

According to the Act No. 7/2005 Coll. Bankruptcy and Restructuring Act (hereinafter referred to as the „the BRA“) the creditors of the Debtor have to lodge their claims in a basic time period of 45 days beginning with the declaration of the bankruptcy on Debtor´s assets in on original to the Bankruptcy administrator to the address: JUDr. Peter Škrabák, Office seat at: Skuteckého 30, 974 01 Banská Bystrica, Slovak Republic.

Ak veriteľ doručí správcovi prihlášku neskôr, na prihlášku sa prihliada, veriteľ však nemôže vykonávať hlasovacie právo. Veriteľ má právo prihlásiť sa do konkurzu do času, kým správca neoznámi v Obchodnom vestníku, že ide zostaviť rozvrh.

If the creditor delivers the application to the Bankruptcy Administrator at a later date, the creditor shall be considered, but the creditor may not exercise the right to vote. Creditor have to lodge their claim until the trustee´s notice of creation the allocation is published in the Government Journal.

Prihláškou je možné uplatniť aj pohľadávku, ktorá má veriteľ voči inej osobe ako úpadcovi, ak je zabezpečená zabezpečovacím právom vzťahujúcim sa k majetku úpadcu.

Creditor who have a claim against the another person as the Bankrupt, if this claim is secured with security right applicable to the estate of the Bankrupt, lodge his claim in the same way.

Prihláška musí byť podaná na predpísanom tlačive a musí obsahovať základné náležitosti, inak sa na prihlášku neprihliada. Základnými náležitosťami prihlášky sú meno, priezvisko a bydlisko alebo názov a sídlo veriteľa a úpadcu, právny dôvod vzniku pohľadávky, poradie uspokojenia pohľadávky zo všeobecnej podstaty, celková suma pohľadávky a podpis. Celková suma pohľadávky sa v prihláške rozdelí na istinu a príslušenstvo, pričom príslušenstvo sa v prihláške rozdelí podľa právneho dôvodu vzniku.

The registration has to be filled in a specials registration form and fulfill the requirements stated by the laws, otherwise these claims will not be considered as claims in bankruptcy and registration will be ignored. The creditor must fulfill in the registration of his claim the information about the name, surname and the address of the firm and the seat of the creditor and of the Bankrupt, the legal cause of the claim, ranking of the satisfaction of the claim from the bankruptcy general estate, total amount of claim and registration form has to be signed. The total amount of claim in the registration form shall be divided info principal and interest with the legal cause of the interests.

Pre každú zabezpečenú pohľadávku musí byť podaná samostatná prihláška s uvedením zabezpečenej sumy, druhu, poriadia, predmetu a právneho dôvodu vzniku zabezpečovacieho práva.

For each secured claim, a separate application must be filed, indicating the amount secured, the type, the order, the subject matter and the legal reason for the creation of the security right.

Pohľadávka sa uplatňuje v eurách. Ak sa pohľadávka neuplatní v eurách, sumu pohľadávky určí správca prepočtom podľa referenčného výmenného kurzu určeného a vyhláseného Európskou centrálnou bankou alebo Národnou bankou Slovenska v deň vyhlásenia konkurzu. Ak je pohľadávka uplatnená v mene, ktorej referenčný výmenný kurz Európska centrálna banka ani Národná banka Slovenska neurčuje a nevyhlasuje, sumu pohľadávky určí správca s odbornou starostlivosťou.

The claim has to be lodged in the euro currency. If the claim is not logged in the euro, amount of the claim shall determine bankruptcy trustee by calculation according to the reference Exchange rate published on the day of bankruptcy declaration by the European Central Bank or National Bank of Slovakia. If the claim is lodged in currency which reference Exchange rate European Central Bank or National Bank of Slovakia does not state or announce, the sum of claim shall determine bankruptcy trustee with Professional diligence.

K prihláške sa pripoja listiny preukazujúce v nej uvedené skutočnosti. Veriteľ, ktorý je účtovnou jednotkou, v prihláške uvedie vyhlásenie, či o pohľadávke účtuje v účtovníctve, v akom rozsahu, prípadne dôvody, prečo o pohľadávke v účtovníctve neúčtuje.

Documents proving the information provided in the registration of claim have to be enclosed to the registration of claim. A creditor who is the accounting entity shall stated a proclamation of the fact that claim is accounted in creditors accountancy, the scope of accounting the claim or reasons why the claim is not covered.

Veriteľ, ktorý nemá na území Slovenskej republiky bydlisko alebo sídlo alebo organizačnú zložku podniku, je povinný ustanoviť si zástupcu na doručovanie s bydliskom alebo sídlom na území Slovenskej republiky a ustanovenie zástupcu písomne oznámiť správcovi, inak sa mu budú písomnosti doručovať len zverejnením v Obchodnom vestníku.

In case the creditor does not have a seat or an address of a branch office in the Slovak Republic, a representative with an address or seat in the Slovak Republic has to be stated, otherwise delivery to such creditor shall be accomplished only by publishing in the Commercial Journal.

Podanie, ktorým bola uplatnená pohľadávka, ktorá sa v konkurze uplatňuje prihláškou, nemožno opraviť ani doplniť.

The submission, by which the claim was alleged, which will be alleged in the bankruptcy by an application, cannot be corrected or amended.

Toto zverejnenie je určené pre zahraničných veriteľov, ktorých pobyt a sídlo nie je známe z dokumentov dlžníka.

This information is designed for foreign creditors, whose place or residence or seat is not obvious from the documentation of the debtor.
