This information notice is to be filled in and sent by the court or the liquidator to each creditor, immediately after the opening of the insolvency proceedings.

1. Information about the debtor

Dear Madam/Sir,

As the administrator of Erik Kobialko, address Lesnícka 18, 044 17 Slanec, nar. 13.02.1987 (hereinafter referred to as "bankrupt") appointed by the District Court Košice I by its decision on June 8^h 2017, file No: 32OdK/9/2017, effective date June 15^th, 2017, I hereby notify to you that the District Court Košice I has declared bankruptcy against the bankrupt.

2.                Information about proceedings for the lodgment of claims

Due to the aforesaid it is necessary for you not later than by 31^st July 2017 to lodge in the hereafter stated way all your monetary claims toward the bankrupt, that have arisen before declaring bankruptcy against the bankrupt (i. e. before June 15^th  2017), including claims secured by in rem rights or by other security right.

A claim shall be submitted in one counterpart to the administrator to whom it must be delivered within the basic period for submitting claims that lasts 45 days from the declaration of bankruptcy; the creditor shall also deliver one counterpart of the claim to the court within the same period.

Filing of claims must be delivered to administrator of the bankrupt not later than by 31^st July 2017.

If a creditor delivers the claim to the administrator later, the claim shall be taken into account but the creditor may not exercise any voting right or other rights connected with the submitted claim for the receivable. The right to the proportionate satisfaction of the creditor shall not be affected thereby; however, the creditor may be satisfied only from the proceeds included in the distribution plan from the general assets where the intention to draw up the distribution plan was notified in the Commercial Bulletin after the claim was delivered to the administrator. The entry of such receivable into the list of receivables shall be published by the administrator in the Commercial Bulletin, stating the creditor and the claimed sum.

           Where a secured receivable is concerned, the security right must also be duly and timely exercised in the claim delivered to the administrator within the basic period for submitting claims that lasts 45 days from the declaration of bankruptcy, otherwise, it shall expire, i. e. no later than 31^st July 2017.

Claims must be filed in the way specified under Article 41[2] of the Council Regulation (EC) No. 1346/2000 of 29 May 2000 on insolvency proceedings (hereinafter referred to as “Regulation”). In this respect I refer to Article 42(2) of the Regulation whereby the above-mentioned the creditor may lodge its claims in one the official language of their state, but subject to such filing bearing the heading "Prihláška pohladávky"; in such case they may be required to provide a translation into Slovak language.

Any claims, which shall arise after declaring bankruptcy (i.e. on and after 15.6.2017) as well as any non-monetary claims shall be considered as a receivable against the assets and should not be filed after declaring bankruptcy.

ako súdom ustanovený správca úpadcu Erik Kobialko, bytom Lesnícka 18, 044 17 Slanec, nar. 13.02.1987 (ďalej  len  „úpadca“) Vám oznamujem, že Okresný súd Košice I Uznesením sp. zn.: 32OdK/9/2017 zo dňa 8. júna 2017, ktoré nadobudlo účinnosť dňa 15. júna 2017, rozhodol tak, že vyhlásil konkurz na majetok úpadcu a ustanovil ma do funkcie správcu úpadcu.

2.  Údaje týkajúce sa prihlasovania pohľadávok

V dôsledku vyššie uvedenej skutočnosti je potrebné, aby ste nie neskôr ako 31. júla 2017 nižšie uvedeným spôsobom prihlásili všetky svoje peňažné pohľadávky voči  úpadcovi, ktoré vznikli pred vyhlásením konkurzu (t.j. pred 15. júnom 2017), vrátane pohľadávok zabezpečených vecným právom alebo iným zabezpečovacím právom.

Prihláška sa podáva v jednom rovnopise u správcu, pričom správcovi musí byť doručená v základnej prihlasovacej lehote do 45 dní od vyhlásenia konkurzu; v jednom rovnopise veriteľ doručí prihlášku aj na súd.

Prihlášky musia byť správcovi majetku úpadcu (jeden rovnopis) doručené nie neskôr ako do 31. júla 2017.

Ak veriteľ doručí správcovi prihlášku neskôr, na prihlášku sa prihliada, veriteľ však nemôže vykonávať hlasovacie právo a ďalšie práva spojené s prihlásenou pohľadávkou. Právo na pomerné uspokojenie veriteľa tým nie je dotknuté; môže byť však uspokojený len z výťažku zaradeného do rozvrhu zo všeobecnej podstaty, ktorého zámer zostaviť bol oznámený v Obchodnom vestníku po doručení prihlášky správcovi. Zapísanie takejto pohľadávky do zoznamu pohľadávok správca zverejní v Obchodnom vestníku s uvedením veriteľa a prihlásenej sumy.

Ak ide o zabezpečenú pohľadávku, v prihláške doručenej správcovi sa musí riadne a včas uplatniť aj zabezpečovacie právo, a to v základnej prihlasovacej lehote 45 dní od vyhlásenia konkurzu, inak zanikne, t. j. nie neskôr ako 31. júla 2017.

Pohľadávky musia byť prihlásené spôsobom uvedeným v  článku 41 Nariadenia Rady (ES) č. 1346/2000 z 29. mája 2000 o konkurznom konaní  hospodárskom priestore (ďalej len „Nariadenie“). V tejto súvislosti odkazujem na článok 42(2) Nariadenia, podľa ktorého títo zahraniční veritelia môžu svoje pohľadávky prihlásiť v úradnom jazyku svojho štátu,  ak prihláška pohľadávky bude mať v záhlaví uvedené „Prihláška pohľadávky“; v takom prípade sa od nich môže vyžadovať preklad do slovenského jazyka.

Pohľadávky, ktoré vznikli po vyhlásení konkurzu (t.j. od 15.6.2017 alebo neskôr), ako aj nepeňažné pohľadávky sa považujú za pohľadávky proti podstate a tieto sa v konkurze prihláškou neuplatňujú.
